How Employer Sponsorship Works
The 482 visa process generally involves three separate stages:
- the employer becomes or remains an approved sponsor
- the employer lodges a nomination for a genuine skilled position
- the visa applicant lodges the visa application
Each stage has separate legal requirements and supporting evidence obligations.
Errors at any stage can lead to refusal.
Basic 482 Visa Requirements
Genuine Skilled Position
The sponsoring employer must demonstrate that the nominated role is genuine and consistent with the business’s operational needs.
Relevant Skills and Experience
The applicant must generally demonstrate relevant qualifications and employment experience connected to the nominated occupation.
In many cases, at least two years of relevant employment experience is expected.
English Requirements
Applicants usually need to satisfy English language requirements unless an exemption applies.
Health and Character Requirements
Applicants and any dependent family members must generally satisfy Australian health and character requirements.
Salary Requirements
The nominated salary must usually meet applicable migration salary requirements and be consistent with Australian market rates.
482 Visa Streams
Short-Term Stream
The Short-Term stream is generally used for occupations on the short-term skilled occupation list and is commonly granted for shorter periods.
Medium-Term Stream
The Medium-Term stream may offer longer-term sponsorship and possible permanent residency pathways depending on the occupation and circumstances.
Labour Agreement Stream
The Labour Agreement stream applies where an employer operates under an approved labour agreement with the Australian Government.
This may include DAMA arrangements in some regional areas and industries.
